If you are living in Poland and you plan to stay in Poland longer, probably you consider buying a flat or house. Unfortunately, to buy real estate, possessing enough capital is not all.
Generally, before the transaction you have to ask the minister in responsibility for interior affairs for a permit to purchase a property. Whereby, to receive above mentioned permission, the condition is there is no rejection from the Minister of National Defence, and in case of agricultural property the minister with responsibility for agriculture also
Above mentioned restrictions are not only for foreigners and companies registered outside our country but also companies registered in Poland with person without Polish citizenship (or people) who have more than 50% shares or with dominant position.
Minister will issue a permit if the applicant (or – if the applicant is the company – shareholder with a dominant position) fulfills one of the conditions as follows:
With the application, it will be necessary to attach documents proving above mentioned conditions.
The minister can decide to initiate the formal investigation to check the occurrence of the above-mentioned circumstances and whether there is no circumstance to justify rejection, in particular the danger to the security of the state or public order.
The permission may include special conditions that the minister considers necessary to make purchasing the real estate valid. The decision is limited to two years.
But not every real estate purchase requires minister approval – for example in the case of an autonomous dwelling with its land registry record the permit is not required.
If there is a rejection of the permit to purchase the real estate, or the minister’s conditions are not fulfilled, there is no possibility to legally become the owner of a house or big agricultural property.
